There is an obvious contradiction in asking advisers whose professional world revolves around the UK tax and regulatory system how best to establish a business outside it.
UK accountants and tax advisers are trained, regulated and professionally exposed within the UK system. Their day-to-day work concerns UK companies, UK taxation, HMRC, Companies House and UK compliance. Inevitably, that is the lens through which many assess a Gibraltar company.
The result is predictable, a business owner asks about establishing outside the UK and receives a detailed explanation of why they should remain inside it.
This isn't necessarily because Gibraltar doesn't work. It is because offshore and non-resident corporate structures frequently sit outside the adviser's normal experience, professional comfort zone and commercial frame of reference.
The regulatory direction in the UK has made that environment more restrictive, not less. From May 2026, tax advisers interacting with HMRC are subject to mandatory registration requirements and greater regulatory oversight.
For advisers already operating in an increasingly compliance driven profession, there is very little incentive to advocate structures with which they have limited practical experience.
So the safest answer is invariably the familiar one: retain the UK company, remain within the UK system, continue reporting through Companies House and HMRC and accept the associated taxation, visibility and administrative burden. Safe for the adviser does not necessarily mean commercially advantageous for the client.
This is where business owners need to distinguish between UK tax advice and Gibraltar corporate expertise.
A non-resident Gibraltar company is not a UK limited company with a Gibraltar address. It exists within a different jurisdiction, operates under Gibraltar company legislation and is subject to Gibraltar's territorial corporate tax system.
For companies whose income is accrued and derived outside Gibraltar, corporation tax on that income is 0%. Gibraltar has no VAT and provides considerably greater commercial privacy than the UK's public-register model.
Directors and shareholders can reside outside Gibraltar and the business operates beyond Gibraltar without requiring premises or employees within the jurisdiction.
Those aren't theoretical differences. They are precisely why businesses consider Gibraltar in the first place.
Yet we regularly encounter prospective clients who have spent hours attempting to persuade a UK adviser to become comfortable with a structure the adviser neither establishes nor administers and rarely encounters in everyday practice. That is approaching the question from the wrong direction.
You wouldn't ask a Gibraltar corporate specialist to determine how your UK accountant should run their UK tax practice. Equally, specialist questions concerning the establishment and administration of a non-resident Gibraltar company should be addressed by people who actually work with Gibraltar companies.
We understand the application process, the acceptance requirements, the corporate services environment and the practicalities of establishing and administering a Gibraltar company because that is our business.
Your existing accountant has an important role where UK matters remain relevant. That does not make them the natural authority on whether establishing your business in another jurisdiction makes commercial sense.
There is also a wider point. Business owners are entitled to make decisions in the interests of their businesses. They are not obliged to organise their commercial affairs around what is most familiar or convenient for their existing advisers.
If your business has outgrown the assumption that everything must sit inside a UK limited company, the question shouldn't be: “Will my UK accountant approve?” The question should be: “What structure best serves myself and my business?”
If the answer leads outside the UK, the advice and expertise you obtain needs to be capable of travelling with it.
